Foreign National Employment at N.C. A&T

The Division of Human Resources (DHR) frequently receives inquiries from academic departments seeking to bring foreign national scholars to the United States for appointments and lecturers. When making these arrangements, academic departments should keep in mind that U.S. Immigration law prohibits employers from making payments to visitors without work authorization or an appropriate classification for activity. These regulations are in effect even if the visitor is only on campus for a brief lecture, appearance or an invited guest to attend a conference. It is imperative that the University be in full compliance with all University, Federal and State regulations regarding employment and payments to temporary status holders while in the U.S.

Immigration regulations are complex. Therefore, it is highly recommended that academic departments work proactively to correspond their intent to employ or the possibly to select a foreign national visitor for employment with the appropriate administrative office(s) responsible for managing the employment-based category. This will ensure the department has a clear understanding of all required internal and external procedures (as applicable) that govern the available non-immigrant status for employment authorization specific to the position/type of employment.

A foreign national (or any final selected candidate) should never be offered employment without first completing and clearing the University’s criminal conviction check procedure through the Division of Human Resources. In addition, a foreign national is never authorized to begin work without receipt of immigration authorization constituting employment eligibility with N.C. A&T.

The Foreign National Employment Policy, along with other applicable University policies, governs the hiring and compensation benefits for foreign national employees and visitors. Academic departments seeking to bring scholars to the United States for appointments and lecturers at North Carolina A&T must do so based on the procedural instructions and guidelines established by University policies.

The Staffing Services Office within the Division of Human Resources works in partnership with Academic Affairs and other Administrative Offices to ensure compliance in the employment process for foreign nationals at North Carolina A&T.

All F-1 and J-1 status categories are processed and approved by the International Students and Scholars Office (ISSO) in the Division of Student Affairs. Departments interested in cultural and international exchange visits and employment opportunities should consult with ISSO prior to initiating any official invitations or offers of employment on behalf of N.C. A&T. ISSO will consult/coordinate hiring efforts with the Staffing Services Office.
